EXPERIENCE

Howard Roston has a diverse and extensive real estate litigation background and has represented public entities and numerous individuals and companies in the areas of eminent domain/condemnation, real estate tax protests, foreclosures and receiverships, zoning and land use, landlord/tenant, lien law and construction dispute resolution. Mr. Roston has successfully tried many jury trials, commissioners’ hearings and arbitration proceedings to successful conclusion for his clients. Mr. Roston is well versed in all court proceedings and dispute resolution processes involved in his practice areas and provides efficient and timely service to his clients. In addition, Mr. Roston is adept at analyzing appraisals, construction contracts and loan and other real estate documents in the representation of his clients.

Mr. Roston has successfully tried condemnation cases before the court-appointed commissioners resulting in multiple awards in excess of $5,000,000 for his clients. He recently obtained a high six-figure jury verdict in a condemnation case after a multi-day trial. He has also successfully defeated unlawful efforts to condemn private property on a number of separate occasions. Mr. Roston also represents owners of commercial, industrial and retail properties in cases where the property is unfairly taxed. He has successfully resolved matters in Hennepin County, Ramsey County and Carver County and recently secured valuation reductions of more than $30,000,000 for several downtown properties.

Mr. Roston has recently been retained to represent lenders to foreclose several commercial properties in the Twin Cities Metropolitan Area, including securing the appointment of receivers.

Mr. Roston represents private property owners in zoning and land use approvals and disputes. His clients include a large real estate investment trust with more than 2 million feet of leased space in Minnesota, including office-showroom, downtown office buildings and warehouse properties. He has obtained zoning and land use approvals for residential, industrial and commercial development projects in the Twin Cities and Greater Minnesota. He has represented clients before planning commissions, boards of adjustment, city councils and county boards in matters pertaining to variances, conditional use permits, planned unit developments and related matters. Mr. Roston also is skilled in assisting clients in all aspects of commercial and industrial leasing and in landlord/tenant dispute resolution. He has first-chaired trials representing landlords in landlord/tenant disputes.

Mr. Roston counsels owners and contractors in construction related disputes. He has first-chaired construction arbitration proceedings before the American Arbitration Association. He represented a real estate developer in a multi-million dollar construction-related dispute and was co-counsel in a dispute involving three parties and a “Class A” office tower in the Twin Cities involving construction issues, cost-allocation issues and Torrens issues. In addition, Mr. Roston represents property owners and contractors in the prosecution or defense of mechanics’ liens.

Prior to joining MGM, Mr. Roston was associated with the firms of Doherty Rumble & Butler, P.A. and Maslon Edelman Borman & Brand, LLP.
